Paragon Component Systems, LLC (“Paragon”) is committed to respecting the privacy rights of its customers, visitors, and other users of the Paragon website located at https://paragontruss.com (the “Site”); the Paragon electronic services provided on or through the Site (the “Services”); any Paragon applications that link or refer to this Privacy Policy (the “Paragon Applications”); any sites that link or refer to this Privacy Policy, such as our social media pages and HTML-formatted e-mail messages (the “Linked Sites”); and any Paragon widgets hosted on a third-party site (collectively, the “Widgets”).

Any information you provide to us will be held with the utmost care and will not be used in ways to which you have not consented. We have tried to keep this privacy policy (this “Privacy Policy”) as simple as possible, but some of the information contained within it is technical, and some of the terms within this Privacy Policy may not be familiar to you. This Privacy Policy is only applicable to the Site, the Services, the Paragon Applications, the Linked Sites, and the Widgets (collectively, the “Paragon Content”), and it does not apply to any other third-party websites that you may be able to access from the Site; that are used in connection with the Services that you order; or that are accessible from our Site, the Paragon Applications, the Linked Sites, or the Widgets, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

Information that We Collect

In order to use the Paragon Content, you must disclose certain Personally Identifiable Information (defined below) and Non-Personally Identifiable Information (defined below), and we collect such information and use it in accordance with the practices described in this Privacy Policy.

Personally Identifiable Information

Personally Identifiable Information that we may collect, store, transmit and use include the following categories of information: (i) contact data (such as your name, mailing address, and e-mail address) (“Contact Data”); (ii) financial data (such as your account or credit card number) (“Financial Data”); (iii) biometric data (“Biometric Data”); (iv) mobile device identifiers of users using Paragon Applications on mobile devices (“Mobile IDs”), and (v) demographic data (such as your zip code) (“Demographic Data,” and together with Contact Data, Financial Data, Biometric Data, and Mobile IDs, “Personally Identifiable Information”). We collect, store, and transmit engineering criteria, design loads, truss drawings, plans, specifications and related documents (“Component Designs”) in connection with the Services that contain Personally Identifiable Information, but we do not obtain any Personally Identifiable Information from such documents. Such data may include Personally Identifiable Information.

Non-Personally Identifiable Information

We automatically track and collect the following categories of information when you visit oruse the Site, or use the Services, the Paragon Applications, the Linked Sites, or the Widgets: (i) Internet protocol (“IP”) addresses; (ii) domain servers; (iii) types of computers (including mobile devices such as tablets and smartphones) accessing the Site; (iv) navigation paths used while visiting the Site; (v) submitted documents; (vi) browser preferences; (vii) installed plug-ins; (viii) local storage preferences; (ix) screen resolutions; (x) local time zones; (xi) font listings; (xii) user agent information; and (v) the types of web browsers used to access the Site (collectively “Non-Personally Identifiable Information”). Non-Personally Identifiable Information is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We also use “cookies” to, among other things, customize content specific to you. Our cookie policy is described below.

How We Use Your Information

Any information that we collect from you may be used in one or more of the following ways:

Personal Information Shared with Certifying Professional

If you use our Services to send a Component Design to an engineer, architect, or other professional (a “Certifying Professional”) for electronic certification, certain Personally Identifiable Information will be shared with such Certifying Professional as follows: your name, your email addresses, and your user agent information, as well as any Personally Identifiable Information included in the Component Design.

Personal Information Shared with Requesting Party

When a Component Design has been electronically certified using the Services, Paragon will generate a certified Component Design in Portable Document Format (a “Certified Component Design”). If you use our Services as a Certifying Professional, your Personally Identifiable Information will be shared with the party requesting such certification (a “Requesting Party”) each time you certify a Component Design using our Services. Upon your certification of a Component Design, the Requesting Partyreceives a copy of the Certified Component Design, an appended signature of authenticity (an “Authenticity Certificate”) and certain metadata. The Certified Component Design, Authenticity Certificate, and related metadata may contain the following information about the Certifying Professional: name; email addresses; IP addresses; drawn signatures; and checksums, which may represent, but not reveal, biometric signature data, system preferences, browser preferences, installed plug-ins, local storage preferences, screen resolutions, local time zones, font listings, and user agent information (such information, “Checksum Metadata”), as well as any Personally Identifiable Information included in the Certified Component Design.

Resale or Disclosure of Personally Identifiable Information to Third Parties

We do not sell, rent, loan, trade or lease any Personally Identifiable Information collected on the Site. On occasion, we sell, rent, loan, trade or lease Non-Personally Identifiable Information collected on the Site.We also may periodically mine anonymous statistical information (i.e.Non-Personally Identifiable Information)and make it available to third parties and our business partners.

We may share certain Personally Identifiable Information we collect about you with our service providers who perform functions on our behalf. Examples include processing credit card payments, sending postal mail and email, analyzing data, and providing marketing assistance and customer service. These service providers are not authorized by us to use or disclose Personally Identifiable Information except as needed to perform their functions or comply with legal requirements, and they may not use it for any other purpose. Further, they must process the Personally Identifiable Information in accordance with this Privacy Policy.

Use of Personally Identifiable Information by Recipients

If you use the Services, we have no control over the data collection, storage, or transmission practices of any Certifying Professional, Requesting Party or any other registered user. If your Component Designs contain Personally Identifiable Information or other information that you would not want disclosed, you should ensure that the Certifying Professional who will receive your Component Design and any other documents has adopted reasonable administrative, physical, technical, and organizational safeguards.

Browser Information Collected on the Website

We analyze our website logs to continually re-evaluate our Site’s content to improve our Site and Services. These logs do not allow the identification of any Personally Identifiable Information. Our Site also records IP addresses of visitors. An IP address is a number that is automatically assigned to your computer when you use the Internet. We use IP addresses to identify registered users, analyze trends, track user movement, and gather broad statistics. The IP addresses of Certifying Professionals are disclosed on Certified Component Designs.

Use of Cookies

A “cookie” is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on the Site to simplify user login and account management. Your web browser allows you to control and limit cookies on your computer. If you reject cookies, you may still use the Site, but your ability to use some areas or functions of the Site, including your ability to place orders for the Services, may be limited. Cookies will not be sold, rented, or loaned, but they may be used for analytics and advertising purposes in accordance with this Privacy Policy.

Information Sharing for Analytics and Advertising

We use snippets of analytics code written in the Javascript language in our web pages, cookies, and web beacons to track visitors to the Site, provide us with analytics for improving our Site and the Services, and for buying, selling, and delivering online advertising about our Paragon Content. We do not share Personally Identifiable Information with our third-party analytics and third-party advertising partners. Generally, when you visit the Site, or use the Services, the Paragon Applications, the Linked Sites, and theWidgets, certain information, including the web address of the page that you visit and your IP address, may be transmitted to our analytics and online advertising partners. Cookies and Javascript code are used to track visitors’ movements on the Site, what pages are viewed, and how long visitors spend visiting each page. We may retain this information indefinitely.

We share information for purposes of obtaining analytics information and delivering online advertising about our Paragon Content with the following parties:

Do Not Track Information

We do not currently respond to web browser “do not track” signals because of a lack of universal “do not track” signals.

Confidentiality and Security of Personally Identifiable Information

Except as otherwise provided in this Privacy Policy, we will keep your Personally Identifiable Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or © enforce our Terms of Use or any Ancillary Agreements to which you have consented and to which you are a party.

Email

We comply with the federal CAN-SPAM Act of 2003.We will not send you marketing messages if you have opted out. We will not share, sell, rent, swap or authorize any third party to use your email address for commercial purposes without your permission except to the extent that we determine, in our reasonable discretion, is necessary to provide any Services that you have ordered from us. We reserve the right to send you email relating to your account status. This includes order confirmations, renewal/expiration notices, notices of credit-card problems, other transactional emails and notifications about major changes to our Services, Ancillary Documents, or our Privacy Policy. If you have registered for certain online Services provided on the Site, you may receive emails specific to such Services.

We may periodically email you messages about products and Services that we think may be of interest to you. We may use a third-party service provider to perform our marketing emails and provide them with your name and email address so that they can deliver emails to you. You can choose not to receive messages in the future by either (1) following the “unsubscribe” instructions located near the bottom of each email, or (2) you can email us at help@paragontruss.com or let us know at the address provided at the end of this Privacy Policy.

When you sign up to receive email from us, you can select either plain text or HTML (with images) format. If you select the HTML format, we may place embedded pixels or other technologies to determine whether or not readers viewed the email. This process does not leave any information on your computer, nor does it collect information from your computer.

We track, transmit, and retain information about when Certifying Professionals have created, viewed, and certified a Component Design. Requesting Parties who use the Service will receive notifications when a Certifying Professional has created, viewed, and certified a Component Design. As noted above, certain Personally Identifiable Information of a Requesting Party and a Certifying Professional will be disclosed to complete a transaction.

If you send us emails, you should be aware that information disclosed in emails may not be secure or encrypted and may be available to others. We suggest that you exercise caution when deciding to disclose any Personally Identifiable Information or confidential information in emails. We will use your email address to respond directly to your questions or comments.

Protection of your Personally Identifiable Information

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of your Personally Identifiable Information, we have put in place commercially reasonable physical, technical and administrative controls to protect your Personally Identifiable Information. We use standard security protocols and mechanisms to exchange the transmission of sensitive data, such as credit card details. When you enter sensitive Personal Information such as your credit card number on our site, we encrypt it using secure socket layer technology. Credit card numbers are stored at and tokenized by our merchant processing provider and are not stored on the Site. Please note that no method of transmission over the Internet, or method of electronic storage, is 100% secure.

Retention and Deletion

We will retain your Personally Identifiable Information for as long as your account is active; as needed to provide you products or Services; as needed for the purposes outlined in this Privacy Policy or at the time of collection; as necessary to comply with our legal obligations (e.g.,to honor opt-outs), resolve disputes, and enforce our agreements; or to the extent permitted by law. At the end of the retention period, we will delete your Personal Information in a manner designed to ensure that it cannot be reconstructed or read.

Your California Privacy Rights

Under California Civil Code Section 1798.83 (also known as S.B. 27), if you are a California resident and your business relationship with us is primarily for personal, family, or household purposes, you may request certain data regarding our disclosure, if any, of certain personal information to third parties for the third-parties’ direct marketing purposes. To make such a request, please fill out an inquiry form; you may make such a request up to once per calendar year. If applicable, we will provide you, by e-mail, a list of the categories of personal information disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, along with the third parties’ names and addresses. Please note that not all personal information sharing is covered by S.B. 27’s requirements. It is important to note that this opt-out does not prohibit disclosures made for non-marketing purposes. Under the Terms of Use, minors are prohibited from accessing the Site or using the Services. In accordance with Section 22580 of the California Business & Professions Code, we will not knowingly use, disclose, compile, or allow a third party to use, disclose, or compile, the information of a minor with actual knowledge that the use, disclosure, or compilation is for the purpose of marketing or advertising products or services to that minor.
